1. Acceptance

Welcome to FIRME (firme.ca and firme.net). By using this site and the growth diagnostic tool it offers (the “Service”), you accept these terms of use. If you do not agree, please do not use the Service.

2. The Service

FIRME is an online tool that guides you, step by step, through the analysis of your business: its situation, its market, its competitors, its website, its marketing, its technology and its operations. Based on the information you provide and on public sources, the Service produces a diagnostic and an action plan.

The online diagnostic is free. With the same email, it also gives access to a free space on plan.firme.ca to review your diagnostic, create your business website and follow the steps to start a new business (see section 14).

FIRME subscription (paid)

• Content: a multi-page communication and growth plan, personalized from your diagnostic and reviewed by a marketing expert, as well as the paid plan.firme.ca tools described on our site.
• Price: $47 per month, paid online through Stripe and renewed automatically each month (plus applicable taxes).
• Activation: in your plan.firme.ca online space, within 3 business days after the first payment. The plan can be printed or saved as a PDF. You receive an email as soon as it is activated.
• Online space: the subscription also gives access, in plan.firme.ca, to a calendar, a dashboard, results tracking and a customer book with follow-ups. Creating your business website at firme.ca/your-business and the startup steps are offered free of charge, with or without a subscription (see section 14).
• Cancellation and refund: you can cancel your subscription at any time, from your space or by writing to us. Access to paid features remains until the end of the period already paid, then closes; your free features (diagnostic, approved business page or website) remain accessible. A period that has started is not refundable, except in case of error on our part. If your plan is not activated within 3 business days after your first payment, that first month is refunded on request.

3. General information only

The results are generated in part using automated analysis tools and artificial intelligence. They are provided for information purposes and are a starting point for your thinking.

They don’t replace the advice of a professional (accountant, lawyer, financial or tax advisor, marketing specialist) and don’t guarantee any result, particularly in terms of sales, customers or growth.

The results may contain errors, omissions or information that is no longer up to date. It is up to you to check them before making a decision.

4. Your information and your content

You are responsible for the accuracy of the information you enter and must only provide information you have the right to disclose.

Do not enter sensitive personal information (social insurance number, banking or health information, etc.) or personal information about other people without their permission.

You remain the owner of the content you submit. You grant us a limited, non-exclusive authorization to use, process and store it for the sole purpose of providing you with the Service, as described in our Privacy policy.

5. Acceptable use

You agree not to:

• use the Service for illegal, fraudulent or misleading purposes;
• attempt to access the Service, its systems or other users’ data without authorization;
• disrupt or overload the Service, particularly through automated or massive requests;
• systematically extract the Service’s content or copy it to offer a competing service;
• circumvent the Service’s security measures or usage limits;
• have a website analyzed that you don’t have the right to analyze or use the Service to harm a person or a business.

We may suspend or restrict access to the Service in case of use contrary to these terms.

6. Email and verification code

To get the complete version of your plan or find your saved analyses, you must confirm your email address with a six-digit code. This code is personal: do not share it with anyone. You are responsible for activity carried out from your email address.

7. Third-party sources and websites

The Service may rely on public information (websites, search engines, directories) about your business and your competitors. We cannot guarantee that this information is accurate, complete or up to date; it belongs to its respective owners.

The business and brand names mentioned in the results belong to their owners; their mention does not indicate any connection with FIRME. The Service may contain links to third-party websites for which we are not responsible.

8. Intellectual property

The site, the FIRME brand, the logo, the design, the texts, the software and the analysis method belong to FIRME or its licensors and are protected by applicable laws. These terms do not transfer any rights in them to you, except the right to use the Service in accordance with these terms.

You may use the diagnostic and action plan obtained for your own business, including sharing them with your colleagues and advisors. You may not resell them without our permission.

9. Availability and changes to the Service

The Service is provided “as is” and “as available”. We may modify, suspend or end it at any time, including its free features, to the extent permitted by law. We do not guarantee it will be free of interruptions or errors.

10. Limitation of liability

To the extent permitted by law, FIRME is not liable for indirect or consequential damages (loss of profits, customers, business opportunities or data) arising from the use of or inability to use the Service, nor for decisions made based on the results.

Nothing in these terms excludes or limits a liability that cannot be excluded or limited under applicable law.

11. Protection of personal information

The processing of your personal information is described in our Privacy policy, which is part of these terms.

12. Changes to the terms

We may change these terms. The version in force is the one published on this page, with its update date. In the event of a significant change, we will inform you in a reasonable way, for example through a notice on the site. If you continue to use the Service after a change, you accept the new terms.

13. Governing law and language

These terms are governed by the laws in force in Quebec and the federal laws of Canada that apply there. Any dispute falls under the jurisdiction of the courts of Quebec.

This English version is provided for convenience. The parties have expressly required that these terms and all related documents be drawn up in French; in case of difference, the French version prevails.

14. Client space, business pages and websites

Access. The plan.firme.ca space is accessed with your email and a one-time code sent to that email. You are responsible for keeping access to your mailbox. We may suspend access in case of abuse or use contrary to these terms.

Your content. You are responsible for everything you publish on your business page or website (texts, photos, logos, videos, prices, testimonials, links). You confirm that you have the right to use it and that it is accurate. Testimonials must come from real customers, with their permission. Prohibited content includes: pornographic or sexual content, offers of sexual or escort services, the sale or promotion of illegal drugs, illegal weapons, fake documents or counterfeit products, any content involving minors inappropriately, as well as content that is illegal, misleading, hateful or violent, that infringes the rights of others, or that imitates another business. FIRME checks each website before it first goes live, automatically filters certain prohibited content and may remove a website, block an account or report illegal activity to the authorities, without notice or refund. You grant us a non-exclusive, royalty-free licence to host, display and reproduce this content, solely to provide the Service.

Approval and removal. The first publication of a page or website is checked by FIRME before it becomes visible. We may at any time refuse, remove or take offline a page, website or content that does not comply with these terms or that is reported to us, and we will inform you by email. The firme.ca/… address remains FIRME’s property; some addresses are reserved.

Contact form. Messages sent by visitors to your page are forwarded to your email and added to your customer book. You must use them in accordance with applicable laws, particularly regarding personal information and commercial electronic messages (CASL).

Mention and availability. Pages and websites display the mention “Website created with FIRME”. Creating and hosting a website on firme.ca is offered for free, subject to FIRME’s approval; we may limit or change this free offer with reasonable notice. We may change these tools, and we will give you reasonable notice before removing an important feature.

Plan generated with the help of artificial intelligence. The complete plan is prepared from your diagnostic with the help of artificial intelligence tools, then reviewed by FIRME before being activated. It remains general information (see section 3).
